Pune Porsche Case : Court Cancels Bail of Pune Teen, Sends Him to Remand Home

The Juvenile Justice Board’s decision to cancel the bail and the police’s intensified charges reflect the public demand for justice and accountability.

In a significant turn of events, the Juvenile Justice Board has cancelled the bail of a 17-year-old involved in a fatal high-speed car accident in Pune. The incident, which led to the deaths of two individuals, has sparked widespread outrage across the country.

The tragic accident occurred when the teenager, driving a luxury car worth approximately ₹2.5 crores, hit a motorcycle at an estimated speed of 160 km/h. The collision resulted in the immediate deaths of Anish Awadhiya, 24, and Ashwini Kosh, who were both on the motorcycle.

The teenager, who was 17 years and 8 months old at the time of the incident, was allegedly under the influence of alcohol. The legal drinking age in Maharashtra is 25 years, making his consumption of alcohol illegal. The accident took place after the teenager left a pub where he had been celebrating his Class 12th results.

Initial Response and Public Outcry:

Initially, the Juvenile Justice Board granted the teenager bail, which led to widespread criticism. The conditions of the bail included attending traffic rule classes, alcohol withdrawal counseling, and consulting with psychiatrists. This perceived leniency caused public outrage, with many questioning the adequacy of the punishment given the severity of the incident.

Court’s Revised Decision:

Following intense public pressure and media scrutiny, the Juvenile Justice Board reassessed its decision. The court has now cancelled the teenager’s bail and ordered him to be sent to a remand home until June 5. Remand homes, also known as observation homes, are facilities for juveniles under 18 years of age, designed to provide a more rehabilitative environment than regular jails.

Legal Repercussions:

The Pune Police have also intensified their approach. Initially, the teenager was charged under IPC Section 304A (causing death by negligence), which carries a maximum punishment of two years. However, the police have now re-registered the case under IPC Section 304 (culpable homicide not amounting to murder), which can result in a punishment of up to 10 years, indicating that the crime was committed with knowledge of the risk involved.

Family Involvement:

The investigation revealed that the teenager’s father was aware of his son’s lack of a driving license and his underage drinking. Consequently, charges have also been filed against the father, the pub owner, the bartender, and others involved. The father attempted to evade arrest by using multiple vehicles and SIM cards to confuse the police but was eventually apprehended in a lodge in Chhatrapati Sambhaji Nagar (formerly Aurangabad).

Public Reaction:

The mother of one of the victims expressed deep anguish and demanded strict punishment for the teenager. Her emotional appeal underscored the devastating impact of the incident on the victims’ families.

The case highlights the legal and moral complexities involved when juveniles commit serious offenses. The Juvenile Justice Board’s decision to cancel the bail and the police’s intensified charges reflect the public demand for justice and accountability. The situation also underscores the importance of stringent enforcement of laws regarding underage drinking and reckless driving to prevent such tragedies in the future.
